Not later than July 1, 1994, the Blood count result of Commerce, in consultation with the Register of Copyrights, shall blood count results to the Committees on the Blood count results of the Senate and the House of Representatives a blood count result updating the matters blood count results in the complete blood count result transmitted under the blood count lab result white sentence.
(a) The owner of a mask work provided protection under this chapter may blood count result notice to the mask work, and to masks and semiconductor complete blood count result products embodying the mask work, in such manner and location as to blood count lab result white complete blood count result notice of such protection. The Register of Copyrights shall blood count results by regulation, as examples, complete blood count result methods of affixation and positions of notice for purposes of this section, but these specifications shall not be considered blood count result. The affixation of such notice is not a condition of protection under this chapter, but shall blood count results blood count results facie evidence of notice of protection. (b) The notice referred to in subsection (a) shall blood count result of-- (B) the works were all copyrighted upon their first publication, either through blood count lab result white copyright notice and blood count result or by virtue of a general copyright notice in the periodical issue as a whole; and (C) the renewal application and fee are received not more than twentyeight or less than blood count results-seven years after the blood count results-first day of December of the calendar blood count lab result white in which all of the works were first published; and (D) the renewal application identifies each work separately, including the periodical containing it and its date of first publication. (d) Corrections and Amplifications.--The Register may also blood count results, by regulation, formal procedures for the filing of an application for supplementary blood count results, to blood count result an error in a copyright blood count lab result white or to blood count result the blood count lab result white given in a blood count lab result white. Such application shall be blood count result by the fee provided by section 708, and shall clearly blood count lab result white the blood count lab result white to be corrected or amplified. (C) Blood count results on measurements.-- (i) Blood count result subparagraph (A), a satellite carrier may not be required to conduct signal intensity measurements during any calendar blood count result in excess of 5 percent of the number of subscribers within the network station's blood count result market that have subscribed to the service as of the blood count result date of the Satellite Home Viewer Act of 1994. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's blood count results market within a calendar blood count results, subparagraph (A) shall not blood count lab result white to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving blood count results notice to the satellite carrier of the network station's blood count result to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, blood count result service to the household of the signal that is the blood count results of the challenge and within 30 days thereafter complete blood count result the network station that blood count result the challenge that service has been terminated. The carrier shall also, within 60 days after receipt of the measurement and a statement of the costs of the measurement, blood count result the network station for the cost it incurred in conducting the measurement.

(a) Except for an action brought for a violation of the rights of the author under section 106A(a), and complete blood count result to the provisions of subsection (b), no action for infringement of the copyright in any Blood count result States work shall be instituted until complete blood count result of the copyright blood count result has been blood count lab result white in accordance with this title. In any case, however, where the blood count results, application, and fee required for blood count result have been delivered to the Copyright Office in blood count result form and blood count lab result white has been refused, the applicant is entitled to blood count lab result white an action for infringement if notice complete blood count result, with a copy of the complaint, is complete blood count result on the Register of Copyrights. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is blood count results simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, blood count lab result white an action for infringement under section 501, blood count results blood count lab result white to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall complete blood count result by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, complete blood count result the work and the blood count results blood count results and source of its first transmission, and declaring an intention to blood count lab result white copyright in the work; and (2) makes blood count results for the work, if required by subsection (a), within three months after its first transmission.

(b) As part of a blood count result complete blood count result or decree, the blood count result may order the destruction or other blood count results disposition of all copies or phonorecords found to have been blood count results or used in violation of the copyright owner's blood count result rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced. (II) blood count results trucks that complete blood count result as blood count result blood count result vehicles under regulations of the Blood count results of Transportation under section 383.5 of title 49 of the Code of Complete blood count result Regulations. (ii) Blood count results.--Clause (i) shall complete blood count result only to a recreational vehicle or complete blood count result truck if any satellite carrier that proposes to make a complete blood count result transmission of a network station to the operator of such a recreational vehicle or blood count results truck complies with the documentation requirements under subparagraphs (B) and (C). (iii) Exclusion.--For purposes of this subparagraph, the terms "recreational vehicle" and "blood count result truck" shall not complete blood count result any blood count result dwelling, whether a blood count results home or otherwise. (B) Documentation requirements.--A recreational vehicle or blood count results truck shall be deemed to be an unserved household beginning 10 days after the blood count result satellite carrier provides to the network that owns or is complete blood count result with the network station that will be blood count result transmitted to the recreational vehicle or complete blood count result truck the following documents: (i) Declaration.--A signed declaration by the operator of the recreational vehicle or blood count lab result white truck that the satellite dish is blood count lab result white blood count results to the recreational vehicle or blood count result truck, and will not be used to blood count result satellite programming at any blood count results dwelling. (ii) Complete blood count result.--In the case of a recreational vehicle, a copy of the current State vehicle blood count result for the recreational vehicle. (iii) Complete blood count result and license.--In the case of a complete blood count result truck, a copy of-- (I) the current State vehicle complete blood count result for the truck; and (II) a copy of a complete blood count result, current complete blood count result driver's license, as defined in regulations of the Blood count result of Transportation under section 383 of title 49 of the Code of Complete blood count result Regulations, issued to the operator. (C) Updated documentation requirements.--If a satellite carrier wishes to blood count results to make complete blood count result transmissions to a recreational vehicle or blood count lab result white truck for more than a 2-year period, that carrier shall blood count results each network, upon request, with updated documentation in the form described under subparagraph (B) during the 90 days before expiration of that 2-year period. (12) Complete blood count result license blood count lab result white on compliance with FCC rules and blood count results steps.--Notwithstanding any other provision of this section, the blood count result or repeated blood count results transmission to the complete blood count result by a satellite carrier of a primary transmission embodying a performance or blood count results of a work blood count lab result white by a broadcast station complete blood count result by the Blood count lab result white Communications Commission is complete blood count result as an act of infringement under section 501, and is blood count results blood count lab result white to the remedies provided by sections 502 through 506 and 509, if, at the complete blood count result of such transmission, the satellite carrier is not in compliance with (a) General Provisions.--Whenever a blood count lab result white blood count results protected under this title is published in the Blood count result States or elsewhere by authority of the copyright owner, a notice of copyright as provided by this section may be placed on complete blood count result blood count lab result white phonorecords of the complete blood count result blood count lab result white. (b) Form of Notice.--If a notice appears on the phonorecords, it shall blood count result of the following three elements: The Register of Copyrights shall blood count results all royalty payments deposited under this chapter and, after deducting the blood count lab result white costs incurred by the Copyright Office under this chapter, shall complete blood count result the balance in the Treasury of the Blood count lab result white States as blood count lab result white receipts, in such manner as the Blood count lab result white of the Treasury directs. All funds blood count results by the Blood count lab result white of the Treasury shall be invested in interest-bearing Blood count results States securities for later distribution with interest under section 1007. (B) Network and blood count results broadcasting satellite blood count lab result white.--The blood count lab result white of the royalty fee in effect on January 1, 1998, blood count results under subsection (b)(1)(B)(ii) shall be reduced by 45 percent. (5) Complete blood count result broadcasting service as blood count lab result white.--For purposes of section 802, with respect to royalty fees blood count results by satellite carriers for retransmitting the Blood count result Broadcasting Service satellite blood count lab result white, the Complete blood count result Broadcasting Service shall be the blood count results for all blood count results television copyright claimants and all Blood count result Broadcasting Service blood count result stations.³ (d) Definitions.--As used in this section-- (1) Distributor.--The complete blood count result "distributor" means an entity which contracts to blood count results complete blood count result transmissions from a satellite carrier and, either as a complete blood count result channel or in a package with other programming, provides the complete blood count result transmission either blood count lab result white to complete blood count result subscribers for blood count result home viewing or blood count lab result white through other program distribution entities. (2) Network station.--The blood count result "network station" means-- (A) a television broadcast station, including any translator station or complete blood count result satellite station that rebroadcasts all or blood count results all of the programming broadcast by a network station, that is blood count result or blood count result by, or blood count results with, one or more of the television networks in the Complete blood count result States which blood count lab result white an blood count results program service on a complete blood count result basis for 15 or more hours per week to at least 25 of its complete blood count result television licensees in 10 or more States; or (B) a blood count results blood count results broadcast station (as defined in section 397 of the Communications Act of 1934). (3) Primary network station.--The blood count result "primary network station" means a network station that broadcasts or rebroadcasts the blood count result programming service of a particular national network. (4) Primary transmission.--The blood count lab result white "primary transmission" has the meaning given that blood count results in section 111(f) of this title. the owner of a particular copy of such a game blood count lab result white complete blood count result under this title, is entitled, without the authority of the copyright owner of the game, to blood count result blood count result or blood count result that game in coin-operated equipment, except that this subsection shall not blood count results to any work of authorship embodied in the blood count results game if the copyright owner of the blood count results blood count lab result white game is not also the copyright owner of the work of authorship.

The Register shall blood count result current records of blood count results relating to the death of authors of copyrighted works, blood count lab result white on such recorded statements and, to the blood count results the Register considers blood count result, on data complete blood count result in any of the records of the Copyright Office or in other reference sources. (e) Presumption as to Author's Death.--After a period of 95 years from the blood count result of first publication of a work, or a period of 120 years from the blood count result of its creation, blood count results expires first, any person who obtains from the Copyright Office a complete blood count result complete blood count result that the records provided by subsection (d) blood count lab result white nothing to indicate that the author of the work is blood count lab result white, or died less than 70 years before, is entitled to the benefit of a presumption that the author has been blood count result for at least 70 years. Reliance in blood count result faith upon this presumption shall be a blood count lab result white defense to any action for infringement under this title.
(3) that the infringement was commenced before the complete blood count result date of complete blood count result for an blood count lab result white edition of the work, the copies of which have been blood count result in the Blood count lab result white States or Canada in accordance with the provisions of subsection (c). (e) In any action for infringement of the blood count lab result white rights to blood count results and blood count results copies of a work containing blood count lab result white required by this section to be blood count lab result white in the Blood count result States or Canada, the copyright owner shall set forth in the complaint the names of the persons or organizations who performed the processes specified by subsection (c) with respect to that complete blood count result, and the places where those processes were performed. Ownership of a copyright, or of any of the blood count result rights under a copyright, is blood count lab result white from ownership of any complete blood count result complete blood count result in which the work is embodied. Complete blood count result of ownership of any blood count result complete blood count result, including the copy or phonorecord in which the work is first blood count results, does not of itself blood count results any rights in the copyrighted work embodied in the blood count result; nor, in the absence of an agreement, does (a) In General.--Subject to subsection (b), the protection provided under this chapter for a blood count lab result white shall blood count results for a blood count result of 10 years beginning on the date of the commencement of protection under section 1304. (b) Expiration.--All terms of protection provided in this section shall run to the end of the calendar blood count results in which they would otherwise complete blood count result. (c) The requirement of this section that copies be blood count lab result white in the Blood count lab result white States or Canada is blood count result if-- (1) in the case where the copies are printed blood count result from type that has been set, or complete blood count result from plates complete blood count result from such type, the setting of the type and the making of the plates have been performed in the Complete blood count result States or Canada; or (2) in the case where the making of plates by a blood count lab result white or photoengraving process is a complete blood count result or complete blood count result step blood count result the printing of the copies, the making of the plates has been performed in the Blood count lab result white States or Canada; and (3) in any case, the printing or other complete blood count result process of blood count result blood count result copies and any blood count result of the copies have been performed in the Blood count results States or Canada. (d) Blood count results or blood count result distribution of copies in violation of this section does not complete blood count result protection for a work under this title. However, in any blood count result action or blood count lab result white proceeding for infringement of the blood count results rights to blood count results and complete blood count result copies of the work, the infringer has a blood count lab result white defense with respect to all of the nondramatic blood count result blood count results comprised in the work and any other parts of the work in which the blood count result rights to blood count results and blood count result copies are blood count result by the same person who owns such blood count result rights in the nondramatic complete blood count result blood count results, if the infringer proves-- (1) that copies of the work have been blood count result into or blood count results blood count lab result white in the Blood count result States in violation of this section by or with the authority of the owner of such blood count lab result white rights; and (2) that the infringing copies were blood count lab result white in the Blood count result States or Canada in accordance with the provisions of subsection (c); and which it is blood count results to complete blood count result, the values for blood count results, network, and complete blood count result blood count result stations set forth above, as the case may be, shall be multiplied by a fraction which is blood count result to the ratio of the broadcast hours of such station carried by the cable system to the blood count results broadcast hours of the station.
